Electronic Market Reform Contract Endorsement (e-MRCE) - Agreement Process FAQ

--------------------------------------------------------------------------------

1. As an insurer can I request that brokers send Endorsement requests by email to a Team/Corporate Account?

--------------------------------------------------------------------------------

2. Can I use email for urgent endorsements? What if I don’t get a reply within a required time limit?

--------------------------------------------------------------------------------

3. As a broker, can I obtain agreements via different methods (scanned MRCE, email message, paper) on the same contract endorsement?

--------------------------------------------------------------------------------

4. Once the ‘leader’ has agreed the contract endorsement, and I have a number of other agreement parties to contact, can I request agreement from (re)insurers simultaneously by email?

--------------------------------------------------------------------------------

5. Do I have to send every Contract Endorsement remotely?

--------------------------------------------------------------------------------

6. I have 4 Contract Endorsements on the same contract and want to distribute by email; can I combine them onto one email?

--------------------------------------------------------------------------------

7.  I have 4 original contracts (e.g. Excess liabilities, XOL layers etc) with the same Contract Endorsement request. Can I combine the 4 contract endorsements onto one email request where the same agreement party is present?

--------------------------------------------------------------------------------

8. If I have 5 UMRs I have to send 5 emails. For international markets in the past I would send 1. So isn't this 5 times the work?

--------------------------------------------------------------------------------

9. I haven’t received a reply back from the (re)insurer to an endorsement request I sent by email; what do I do?

--------------------------------------------------------------------------------

10. I want to make a (small) amendment to the endorsement; can I change the attachment and send it back agreed?

--------------------------------------------------------------------------------

11. How does/could e-MRCE interact with the IMR?

--------------------------------------------------------------------------------

12.  If insurers print the email off, scratch it and then scan it back in, it does not reduce the amount of scanning they do. Doesn't this defeat the purpose?

--------------------------------------------------------------------------------

13. Can't the insurer just put the document straight onto the IMR?

--------------------------------------------------------------------------------
1. Yes. This is increasingly common as insurers develop new ways of managing the endorsement workflow process. Individuals can of course still be referenced in the “Cc” address field of the email.

2. You will need to assess the most appropriate way to handle these. Using email may in fact provide a convenient means to get the endorsement to the agreement parties rapidly. However, you would probably want to follow this up via telephone or other means to ensure it receives the attention it requires.
It is likely that your organisation already has procedures and protocols for dealing with issues of this nature.

3. Yes, (you may have no choice).

4. Yes, the email distribution methodology allows you to send and receive instructions/ agreements simultaneously.

5. No, but this should become the broker’s default position and should be used for all non-complex Contract Endorsements. Even for Contract Endorsements that require face-to-face negotiation you may still choose to obtain final agreement via email.

6. No. You should send these as 4 separate endorsements as the agreement process and result of each may differ. Referencing the endorsements could also cause confusion when combining them on one email.

7. No. These should be sent as separate emails each providing clear contract, endorsement and insurer references.
  --------------------------------------------------------------------------------

8.  The idea here is to ensure that the processes established in the market now are consistent with what will be required when full electronic processing is adopted. This may seem like more work now, but is still a saving in time over more traditional means

9. Follow the same internal procedures your organisation would use when dealing with other remote parties, e.g. Overseas (re)insurer, where you are waiting for a formal response. If you have an SLA, follow the protocols that have been established.

10. The best practice answer is no, in support of contract certainty and moving towards full electronic messaging, you should make the request and ask the broker to agree and re-send the Contract Endorsement. It should promote ‘right first time’ submission

--------------------------------------------------------------------------------

11. Xchanging will now accept signed and scanned MRCE’s (as part of an A&S accounting submission on IMR) and also emails as evidence of agreement. These may be sent to Xchanging using email

--------------------------------------------------------------------------------

12. Where a signed and scanned copy of the MRCE is required the scanning effort required with e-MRCE may be similar to that previously required. However, this will not always be necessary and the benefits of email usage generally are large.

13. No. Processes or resources currently exist to handle the endorsement agreement process as a centrally provided service. The focus now is to improve the efficiency of the existing agreement processes.
